Deal Insurance Agios Nikolaos informs the insured about a court decision of the Supreme Court on insurance compensation and driving licences. The Communication is as follows:
The Supreme Court, in a recent decision (AP 379/2021), considered that damage from a driver who lacks the appropriate driving licence is excluded from insurance coverage.
Following the decision made by the Supreme Court, insurance companies have the right to refuse compensation for damages by drivers who at the time of the accident:
1) did not have the required driving licence
2) or had an expired driving license which had not been renewed on time
Any claim by the drivers who have been involved in a road accident, without having the required driving licence, that they know how to drive, so the lack of a licence does not affect the outcome of the accident, after that decision has no legal basis. In other words, it cannot be used as an argument to force the insurance company to compensate the injured party.
We encourage drivers to:
- Always drive their vehicles with a valid driving licence
- Drivers whose driving licence needs to be renewed shall ensure that it is renewed before its expiry date. The interval between the expiry and renwal dates of the driving licence is no longer covered by insurance
- Do not drive their vehicles without the minimum compulsory insurance coverage
